This Refund Policy outlines the terms and conditions for refunds related to services provided by Phonate Technologies Private Limited ("Phonate," "we," "our," or "us"), including software development, web development, mobile app development, cloud infrastructure, cybersecurity, and IT advisory (collectively, "Services").
Please read this policy carefully before engaging with our Services. By making a payment for our Services, you agree to this Refund Policy.
1. General Policy for IT and Software Development Services
Due to the nature of custom IT and software development projects, which involve significant upfront work, resource allocation, and intellectual property creation, our general policy is as follows:
- No Refunds for Completed Work: Once a project phase is completed, delivered, and accepted, no refunds will be issued for that phase.
- Advance Payments/Retainers: These are generally non-refundable as they cover consultations, planning, and project kickoff efforts.
- Cancellation by Client: In the event of project cancellation, Phonate may retain advance payments and/or charge for work completed up to the cancellation date. Any unused balance may be refunded.
- Cancellation by Phonate: If we cancel the project due to unforeseen issues or inability to deliver, we will refund any unutilized portion of advance payments.
- Disputes: Refunds will only be considered if we fail to deliver services as per the agreement, and if resolution efforts have failed.
2. Non-Refundable Circumstances
Unless explicitly stated in a separate agreement, the following are non-refundable:
- Fully rendered and delivered services.
- Work that has been accepted by the client.
- Advance payments or retainers, unless agreed otherwise.
- Costs for third-party services or licenses procured for your project.
- Subjective dissatisfaction once contractual deliverables are met.
- Delays or changes caused by the client after project commencement.
3. Refund Process
To request a refund, follow these steps:
- Contact Us: Email support@phonate.in with subject "Refund Request - [Your Name/Company Name]" and include:
- Your full name and company name (if applicable)
- Service/Project name
- Payment date and amount
- Reason for refund request
- Relevant documents or communication
- Review: We will assess your request per this policy and the applicable Service Agreement.
- Decision: You will receive our decision within 7–14 business days.
- Processing: If approved, the refund will be issued to the original payment method within 15–30 business days. Bank/provider delays may apply.
4. Changes to This Refund Policy
We reserve the right to change this Refund Policy at any time. Changes become effective immediately upon posting to our Website. Continued use of our Services after changes implies acceptance of the revised policy.
